1 The threshold issue in this case is whether, on a second appeal, the Court of Appeals was bound by its decision in the first appeal. We answer in the affirmative. After the district court granted summary judgment in favor of the defendants, the plaintiff appealed. The Court of Appeals, Division 2, vacated the summary judgment and remanded the case. After the time lapsed for filing a petition for certiorari, that decision became final. After a jury trial, the case was appealed a second time. On the second appeal, the Court of Appeals, Division 1, rendered a decision inconsistent with the decision in the first appeal.
